Extending a contract.

I am working on getting a contract setup for a potential client. I was wonder what happens if some un-foreseen event occurs that causes me to not finish on time.

In the contract it is stated that:

This Contract ends on July 1, 2016, unless the Client or the Developer ends the contract before that time.

  • What happens if I can't finish by July 3rd?

  • What legal obligations do I have, and what rights does the client have?

  • Can they just leave and not pay me?

  • Should there be anything added to the contract as a safe guard?

Hi Caleb,

Do you want to fire the contract over to me and I'll answer those questions for you.

You want to add a clause called force majeure that covers unexpected and uncontrollable events - but we'll get to that.

If you let me have the contract, I'll see what obligations it places on both parties and what rights you have or payment etc.

As far as I'm aware you can make any policy you wish as your safeguard and it's up to the client to become familiar with it.

You could insist on a non returnable deposit for your work so if the worst happens you don't lose all of your fee.

You may also get in touch with your client, let them know trhere's a problem and propose an amended extension to the contract?
